Understanding Emergency Temporary Standards: Federal and State

The rules of engagement with MSHA and OSHA have changed, and are continuing to be modified in the COVID-19 workplace. One significant development has been the threat of - and in some cases the adoption of - emergency temporary standards (ETS) to address COVID-19 or other infectious diseases. At the federal level, ETSs directed at both MSHA and OSHA have been overturned in the courts but remain active potential threats through Bills in the House and Senate.
